From 1950s Chevrolets to 1980s BMWs, each vintage vehicle represents not just transportation, but a significant financial investment and piece of automotive history.

Title disputes are among the most frequent legal issues vintage car owners face in New York. Unlike modern vehicles with complete digital records, classic cars often have missing or incomplete title documentation. Common problems include:
Key rule: Under VTL §2102, vehicles model year 1973 and newer require a certificate of title in New York. Vehicles model year 1972 and older do not receive titles and instead use a transferable registration as proof of ownership. When proof of ownership is insufficient for titled vehicles (1973 and newer), DMV may require an indemnity bond under VTL §2105. The bond amount is determined by the DMV Commissioner and is typically equal to one and one-half times the vehicle's value as a safeguard against competing ownership claims.
These title problems can prevent DMV registration or result in losing your collector car to someone claiming prior ownership. I work directly with the New York DMV's Title Services Bureau to obtain bonds when necessary, clear defects, and resolve ownership disputes.
New York has two main registration options for older vehicles: Historical Plates (HX/HM) and Vintage (Year-of-Manufacture) Plates.
Under VTL §401, a historical motor vehicle means any vehicle manufactured more than 25 years prior to the current calendar year. Both historical and vintage plates are restricted to vehicles owned and operated as exhibition pieces or collector's items, used for club activities, exhibits, tours, parades, occasional transportation and similar uses, but not for general daily transportation.
Inspection rules: Under New York law, all registered vehicles must pass an annual safety inspection covering brakes, steering, suspension, tires, lights, windshield, wipers, horn, mirrors, seat belts, and fuel systems. Vehicles 25 model years or older are exempt from emissions testing under 6 NYCRR Part 217, but they remain subject to the annual safety inspection requirement. There is no age-based exemption from safety inspections in New York.

After investing $50,000 to $500,000 or more in your vintage vehicle, an insurance dispute can devastate your finances. I challenge lowball settlement offers, work with classic car appraisers, negotiate with specialty insurers, and file bad faith insurance claims when warranted.
Classic car transactions involve substantial money and require careful legal documentation. Common issues include:
New York’s Used Car Lemon Law (General Business Law §198-b) requires dealers—defined as anyone who sold three or more cars in the past 12 months—to provide a limited warranty on qualifying used cars. It does not apply to private sales, vehicles manufactured before 1984, or cars with more than 100,000 miles. Because of these restrictions, most antique and classic vehicles fall outside the law’s coverage.
Since many classic cars exceed the law’s mileage and age thresholds—or are bought directly from private sellers—the Used Car Lemon Law rarely protects collectors. That means most disputes over vintage car sales must rely on other legal theories, such as fraud, misrepresentation, or breach of contract.

Under Lien Law §184, mechanics and storage facilities in New York can place liens on your classic car for unpaid repair, storage, or towing bills. However, they must follow strict notice and sale procedures under Lien Law §§200-202 before they can legally sell your vehicle. Section 201 requires a 10-day payment demand and service via certified mail, while Section 202 specifies public auction requirements for property valued over $100.
Importing vintage vehicles involves complex federal and state regulations. Under 49 U.S.C. §30112 and 49 CFR §591.5, vehicles at least 25 years old from the date of manufacture are exempt from Federal Motor Vehicle Safety Standards without requiring modifications. This is the DOT/NHTSA exemption.
The EPA exemption under 40 CFR §1068.315 allows vehicles 21 years or older to be imported without meeting current emissions standards, but only if they remain substantially in their original configuration.
